Bailed For Attempted Rape: Accused Of Rape

Thirty five year old Rudolph Tubba Smith, an unemployed of Hattieville who was released from prison last week on bail for aggravated burglary with intent to commit rape, is back in the hands of the law charged this time with rape and aggravated burglary. Smith was arraigned on the charges today in the Magistrate's Court. The prosecution objected to bail on the grounds that the offences are of a serious nature, that the age of the complainant is 15 and that Smith has two other similar charges for which trial is pending.

Senior Magistrate Sharon Fraser upheld the objection and she remanded Smith into custody until December 23. The girl reported to the police that she was asleep in her house in the Albert Area when Smith entered as a trespasser and put a knife to her throat. She said Smith told her to shut her mouth otherwise he will hurt her little brother and sister sleeping on a bed next to hers. The girl said she remained silent and Smith turned her over on her back and raped her.

The police reported that Smith was positively identified by the girl in an identification parade.
