And while Eipfania Caliz is free from this charge - she may be facing another - and that is for assaulting court reporter Anita Nembhard.
But even though a law was recently tabled in cabinet to offer protection against assault to media workers, Nembhard says she is having a hard time
filing a report against Caliz who purposely coughed in her face while leaving court on Tuesday.
And today, Nembhard says she will not be accepting an apology from Caliz through her attorney Dickie Bradley. Jomarie Lanza has this report:
While Elmer Nah and his common law wife, Eipfania Caliz, got off in court today on ammunition charges. Are there any possible charges brewing against Caliz
after she assaulted court reporter Anita Nembhard. Coughing on her while leaving court, pulling down her mask and deliberately coughing in her face. Nembhard
told us today that through her attorney, Caliz offered her an apology.

"I will not accept an apology at this moment from Eipfania Caliz because first, that's not a genuine apology, first of all. She saw me a few minutes ago.
Right. And her action does not justify."
Reporter:
"What was her action?"
Anita Nembhard Flowers, Reporter
"Her action that day, well today she seemed more afraid to approach me. But I am not. I am not the problem right."
"But she should have thought twice before doing what she did, because she knew also that she had a case before the court. She has a child or she has children.
Why are you going to think about that now, after what you did? And the other thing is, too, that I was hoping the police department would look into. I told
the officer on that day when nothing happened, I had a video footage up to when I made my report."
"The police officer never once said, okay, let me get this this footage from you. He did not even want to look at the picture that I was showing him to say
the color of the clothes that the young lady was wearing, who I'm describing. He quit to put his own color. I had to correct him in a lot of stuff that I
was making in the report."
Caliz's attorney, Dickie Bradley, says that his client sends her apologies to Nembhard and hopes she can understand that her actions were as a result of
emotional distress due to the court proceedings that were taking place.

"They caughed on Anita and all the way that the thing took so long. I wanted to say that Miss Caliz asked me to please say to the media that she was under
tremendous stress. She's a public officer and a mom, that her husband is in jail all this time. She has not worked for all the time that she has been arrested
wrongfully and has been she has been persecuted, not prosecuted."
"This really way out and ridiculous that you're in a vehicle. There is no proof whatsoever that you are responsible for any ammunition which belonged to the
police, which they know is police ammunition, and that poor woman has suffered to come to court over such a long, long period and has not been able to work all
this while. It's a terrible stress."
"So she wanted she was waiting to say. But you all were busy. She wanted to publicly, personally apologize for losing control of her emotions on the last
occasion."
Reporter:
"But at the same time as a member of the media sir. You would expect that they would set precedent with a case like this, especially after a pandemic. And she
deliberately takes off her face mask and coughs in the face of a reporter. She knew what she was doing, sir."

"You want her to go to jail?"
Reporter:
"No, it was deliberate."
Dickie Bradley, Attorney
"You want the law that hasn't passed yet apply to her. All right. Let's talk about things that actually happened today in court. Nobody coughed on anybody
in the court."
Reporter:
"She expressed fear for her own safety. And that is the reason why we are here talking to you about it."
Dickie Bradley, Attorney
"Well, then you're asking the wrong person. I didn't cough on anybody."
Bradley claims that Caliz did want to apologize to Nembhard, but as the court session ended, she was seen taking off towards her vehicle, ignoring all the
reporters in her path, including Anita Nembhard, which led to a sharp exchange with Caliz's attorney.

"You need to tell Eipfania Caliz that Anita will not take an apology from her."

"Don't say that darling. Don't say that."

"Why are you telling me? It's not me who spit on you."

"Yes, but then I saw."

"Your asking me to accept an apology."

"So if she dies it is me they will bury."
Last word from Nembhard is that the OC of the Caribbean Shores station says he just learnt of her report, so he is now looking into it and then they
will locate Caliz and charge her.
