And though there is a lengthy wait for this ruling, ex-police officer Elmer Nah - who is one of the Bladen 12 - has other legal worries at the High Court.

He was indicted today for the Ramnarace murders. Nah was represented by attorney Godfrey Smith who appeared virtually.

He was read two separate indictments- one for 4 counts, 3 counts of murder for John David and Vivian Ramnarce and one count of attempted murder for Yemi Alberto. Those will be heard in a trial without jury. And the other indictment is for use of deadly means of harm and wounding which will be tried by a jury.

Nah pleaded not guilty to the offenses and was informed by Justice Pilgrim of the dates for case management documents to be filed and a hearing will be scheduled for October 16 and 17. The prosecution is awaiting forensic analysis results that could impact the trial's timeline which may run into 2025. Nah was informed of his constitutional rights also including the possibility of negotiating a plea deal.
