It was the pistol whipping seen all around Belize. In July of 2024, Sergeant Devon Makin pistol whipped Ryan Melendez in plain view of a camera. Police said a complaint had been made against Melendez - but he was never charged with any offense.
But Melendez - through his attorney David McKoy did bring suit against the Attorney General, the Commissioner of Police and Sergeant Makin.
The suit claims he suffered assault and battery under Makin's use of unjustified force with a dangerous weapon and asked for damages to be awarded.
Well, it might have looked good on paper but the case fell apart in the High court today. Makin's attorney Hector Guerra pointed out to Justice Nadine Babi that no notice of intended action had been issued to government a month in advance as required by the Public Authorities Protection Act.
The judge agreed and the suit was dismissed. Makin - who is the Commissioner's godson - has not faced any disciplinary charges for the act.
