General Legal Council Finds Attorney OJ Guilty Of Professional Misconduct

The General Legal Council - which responds to complaints the public makes against attorneys - has publicly posted a bombshell judgement. This time the complaint is against OJ Elrington.

A widower from Dangriga, Pastor Dozie went to Elrington in May of 2022 because he was not being allowed by social Security to claim his survivors grant after his wife died. Dozie said he was being discriminated against because he is a widower and not a widow. So he asked Ellington to file a constitutional claim.

Dozie paid down $1,500 dollars and they signed an engagement agreement where Elrington would get a percentage of any sums recovered from SSB.

Elrington got into negotiations with the Social security Board, but then a strange thing happened. His paralegal reported to Dozie that Social Security had made an offer of 40,000 thusand dollars to settle the claim. But the law firm advised Dozie not to take it. And then Elrington went ahead - and did just that, he accepted a settlement for a little over 46 thousand dollars - except he never told Dozie.

Elrington then collected the settlement sum - and according to the GLC opinion, he continues to possess the said sum and has not paid any portion to Dozie. In his defense, Elrington says that Pastor Dozie never gave him a bank account number to transfer the funds to.

In his defense Elrington said that Pastor Dozie was not concerned too much about the settlement sum, but was more interested in the legacy of his deceased wife. He wanted to get a commitment from the SSB and the government that the law would be amended for pension benefits to be paid to widowers as well as widows. Elrington said that's why he approved the settlement since it contained the commitment to amend the law.

Nonetheless, In its findings, the council concludes that Elrington "was fully aware that the standard practice in settling claims for clients was to obtain their written approval" for settlements, which was not done in this case. And that he signed off on the order without consent which constitutes "grave professional misconduct." They have summoned him to a hearing on May 24th to hear the sanctions that will be imposed against him.

Notably, the GLC also expressed concern about the authenticity of a document allegedly signed by his client that Ellington entered as evidence. They say they will send it to the police to determine whether Pastor Dozie's signature was fabricated.
