Now, that is some very harsh language, referring to dyed in the wool UDP'S as "thugs" and "gangsters", but such is the nature of the UDP discourse at this juncture.
But setting that emotional language aside and coming now to the facts of the matter: Tracy Panton's group has stated that it is lawfully managing and controlling the entire premises of the UDP headquarters, quote, "on the authority of the Trustee."
That's former Secretary General Phillipa Bailey - whose name appeared on the 2010 land transfer document. But, Shyne Barrow today presented to the media a Jamaican law professor who told us in a zoom interview that Bailey's name on that document is neither here nor there:
Dr. Chris Malcolm, "Interested Observer"
"No, the land was not put in the name of trustee. I have seen a copy of the title and the title has the UDP as the registered owner. I have seen it."
Jules Vasquez
"But it also has the name of the secretary general at the time."
Dr. Chris Malcolm, "Interested Observer"
"No, the title, there are two things you need to bear in mind. There's an instrument of transfer, but the title, the instrument of transfer is merely the document which allows for recording on title."
"What is supreme is the, is not the instrument of transfer, but the title itself is not for a trustee, so-called trustee. I don't know whether the person was a proper trustee or not. Is not for any individual to assert a right of claim because that right of claim, when it is held up against the title, the question is, but your name does not appear on the title."
"What appears on the title is the UDP. So the UDP is a legitimate owner."
Malcolm says he has not been retained by Shyne Barrow and is just an interested observer. He recently was in Belize doing training in criminal mediation.
Barrow told us that he's taking the matter to court on Friday with the firm of Glenn D. Godfrey.
