He lost a major case in the high court last month, but Mike Feinstein is appealing the decision.
In late January, the court ruled that the government had lawfully acquired 23.4 acres of land on Stake Bank that was in Feinstein's name.
In an appeal filed yesterday Fienstein's attorney Godfrey Smith argues among other things, that the judge made a mistake when he found that the acquisition was for a genuine public purpose. The appeal argues, quote, "the acquisition was for the arbitrary, politically expedient purpose of bringing an end to "messy" litigation and aid the
private interest of private sector bankers and investors." End quote.
Smith also asks the court to grant an injunction restraining the government from quote, "taking any steps to lease, transfer, dispose of, or otherwise part with ownership: of the 23.4 acres of land."
That is set to be heard on Monday, but, tonight we can report, it's too late for that. 7news has confirmed that Government has already fully acquired and transferred the land to Stake Bank Enterprises Limited. That is the group now in receivership which seeks to develop the island as a cruise port.
