2 years after he was remanded for allegedly stabbing a customer to death in a bar fight, 34 year old Elder Arana is now a free man.
That's after one of the crown witnesses failed to positively identify Tun as the man who fatally stabbed 30 year old Elder Arana.
The incident happened in March of 2023 at Jeemar's night club in San Pedro Ambergris Caye. A fight had broken out in a bar, which led to the fatal stabbing of Arana.
Tun's murder trial began in January of this year and the DPP called a total of 14 witnesses, 7 of which took the stand.
One of those witnesses was Diego Santos who served as an eye witness, but his credibility was questioned due to a number of inconsistencies and his inability to remember critical details.
As a result of this he turned hostile on the stand and the Judge, Derrick Sylvester concluded in a 30 page ruling that the crown had failed to identify that it was Tun who inflicted the injury to Arana and caused his death. As a result of this, Tun was acquitted today of all charges and here's what he and his attorney had to say as he walked out of court free.

"Mr Tun was acquitted this morning the court decided or took the view that the evidence given by the crowns main witness Diego Santos was filled with inconsistencies and therefore it did not prove beyond a reasonable doubt that our client was the person who actually inflicted the stab wounds on the deceased Elder Arana."
"In 2023 a bar fight occurred in San Pedro and this bar fight started because they wanted to close the bar earlier and Mr Tun decided to help the security remove people from the establishment. These persons were removed from the establishment and it caused an altercation in one person being stabbed 6 times and Mr Tun was the person they were accusing being that the star witness Mr Diego Santos he stated that he saw the person the accused take out a shiny object and made Juking motions the two juking motions. However the court stated that his testimony and credibility could not be relied on so today Mr Tun was acquitted of all charges and is a free man."
