Shyne Prepared Lawsuit Ahead Of EBC Decision

Untitled Document But, that's now in the past - and the UDP has to prepare to overcome its next hurdle- and that is for the control of the color red on the ballot. Both Shyne Barrow and Tracy Panton are making competing claims to be the leader of the one true UDP.

Barrow told us yesterday that he'll go to court to fight for it:

"I sent a letter to your newsroom to Mr Vasquez, and to all your newsrooms and you know I don't bluff. When Hondora made a decision we didn't agree with, we went to the court of appeal. Lots of people talk it, they have five terms in office and they claim to be so sophisticated, yet they're just talk. I go to the courts, I believe in the judiciary and I look at none other than Michael Ashcroft, lost in Supreme Court, lost in Court of Appeal, always wins in CCJ. So when it comes to democracy, when it comes to the rule of the law, we go through the process. So when it comes to Elections and Boundaries if they take a decision that we don't agree with, we will go to court. My lawyer, I will send you the letter from my lawyer, I wrote a letter from my party this morning to the Chief Elections Officers and lawyers are following up because we need to see what they do today to tell them, we think you will do this and if you do this, this is what we will do so let's see what they do and we'll file the civil action."

In a release from the Elections and Boundaries Department a short while ago, says, quote, "As it relates to the allocation of the traditional red colour to the United Democratic Party ("UDP")….By a majority vote of 4-1, the EBC voted….to allocate the traditional UDP red to all 41 candidates applying under the UDP banner.

In a decision issued today, the High Court did not grant any order restraining Ms. Panton from holding herself out as the UDP or from using related UDP items including the party's name and symbols, reinforcing the need for the EBC's balanced and impartial stance."Given that the courts have yet to determine the rightful leadership of the UDP, the EBC has taken this approach to maintain neutrality, absolute even-handedness and uphold electoral integrity."end quote.
