We all know about what's been happening with the contract NICH
gave to David Gegg's Cruise Solutions at the Cave's Branch archaeological
Reserve. Well the other Cave's Branch attraction, Jaguar Paw Resort is
having its own dispute with Gegg which came to a head on December 11TH when
Gegg's Cruise Solutions was barred from taking its tours to Jaguar Paw,
pending the payment of hundreds of thousands of dollars in arrears. The case
went to court today and it was adjourned – but there was a significant
development. Justice Minette Hafiz Bertram has agreed to delay the proceedings
until after an annual general meeting of Zipline Adventure Tours Limited to
see if the parties can settle the dispute among themselves.
Attorneys representing both sides are confident that the issues can
be resolved and that the applications made by both Jaguar Paw and Gegg will
likely be withdrawn. But in chambers today, Jaguar Paw's attorney Elson Kaseke
argued that his client should be awarded costs. Justice Hafiz agreed and has
awarded Jaguar Paw fifteen thousand dollars. That sum brought little comfort
to Jaguar Paw's Donna Young who says the closure of the tubing and zipline tours
has meant substantial
Donna Young, Owner, Jaguar Paw
"We've lost business because of the zipline, it's hurt taxi drivers,
it's hurt other tour operators, and we've lost hotel reservations. So
it's not just David Gegg that's hurting, of course he claims he is the victim,
but actually he's the perpetrator. If he would just pay his bills. And actually
I'm going to ask that he get a cashier's check for the fifteen thousand dollars."
Janelle Chanona,
"This man is still your business partner, how do you expect..."
Donna Young
"Unfortunately he is, that's going to be a problem. He is my business
partner and it's something that I would never done to be begin with. But that
was something between he and my husband but my husband is no longer here so
I have some extra baggage I have to deal with."
Michel Chebat, Gegg's Attorney
"Those matters we are hoping will be resolved at that meeting where
all the parties can sit down and really trash this out."
Janelle Chanona,
"Your client saying he's willing...cause I know the other side is saying
they need to get paid because they are hurting."
Michel Chebat
"My client needs to get paid also so there's a question that both
sides, apparently there are monies that are owing on both sides so some accounting
needs to be done okay?"
Janelle Chanona,
And you're confident the AGM will clear this up?
Michel Chebat,
"We are sure that on the 13th if not all of these matters, most of
them will be cleared up and resolved."
Of note is that while this case may be winding up, Donna Young is also
claiming that Gegg's Discovery Expeditions and Cruise Solutions owes her another
monster payment. Young also says she has yet to receive dividend payments from
the Zipline tours to the tune of six hundred thousand dollars. As Chebat pointed
out in his interview, his client, David Gegg maintains that Jaguar Paw also
owes him money. The shareholders meeting is scheduled for January 13th in Belize
City.
