And Elrington’s case is just one of more than a dozen presently before
The Court of Appeal in its first session of 2009. Over the next three weeks
Justices Mottley, Carey, Morrison and Sosa are expected to preside over a number
of criminal and civil cases. But by all accounts, the highlight of the session
will come on March 27th when the Justices will be handing down their judgments
in several matters, including the much-anticipated appeal by the Government
of the Chief Justice’s “expectation” that a referendum be
held prior to the enactment of Constitutional amendments proposed by the Barrow
Administration.
Not surprisingly, a number of other appeals lodged before the Court of Appeal
are cases brought by the Belize Bank and Telemedia respectively over the decisions
of trial judges involving business tax arrears. The Bank has also appealed the
order of the Central Bank to pay ten million dollars into the Government Treasury
as part of the Venezuela Grant Funds investigation.
The Justices have also set aside two days to hear the long-awaited appeal of
Belize City businessman Rhett Fuller regarding extradition proceedings against
him. Other cases of interest include an appeal by Paul Goguen of Ara Macao against
Mary Toy and her environmental group as well as an appeal against the CJ’s
decision in the case of Sagis Investments and Krem Radio regarding shares in
the media house.
This session of the Court of Appeal is scheduled to close on March 27th.
