He was once dubbed the serial rapist - and was recently sentenced to 18 years in prison for rape, robbery and aggravated assault but since then Leroy Gomez has gotten off two counts of rape. Today it was a nolle pros, but it wasn't because the evidence was lacking; it's because the woman who accused him has died - even though she was only 26.
So the 23 year old Gomez was freed of charges of rape and robbery in Justice Adolph Lucas's courtroom.
Justice Lucas explained to Gomez that the case can be brought back because there is a provision in the law for a person's statement alone to be admitted as evidence.
The alleged rape happened two years ago, around 2:15 on the morning of September 15, 2008. The victim told police she left Bismarck club with a friend who dropped her off near Iguana Street. She was walking on Iguana street when a man rode up on a bicycle, held her at knife-point and dragged her to a basketball court where he raped her. He also stole her cell phone.
The three incidences of rape Gomez was accused of occurred between August 28 and September 15, 2008, in all cases the victims were held at knifepoint, after midnight, and all occurred within the same general area of Collet and Lake Independence…
