Accused Killer Pleads Guilty

Thirty three year old fisherman Marcos Moh charged with the murder of 33 year old Kirk Smith, pleaded guilty to the lesser charge of manslaughter today in the court of Justice Adolph Lucas.

The incident occurred on October 10, 2008 in the vicinity of Turneffe Island. Trevor Johnson and Jason Westby, who were in the boat with Smith when he was shot and killed reported to the police that they were about 3 to 4 miles from Turneffe diving up lobster and lobster traps when Moh who was in another boat, approached them.

Johnson and Westby said Moh shot Smith and they commandeered the vessel abnd sped off. But they were pursued by the Moh who fired about 5 more shots which hit their boat.

Johnson said he and Westby jumped over board to escape. Johnson and Westby retrieved the boat with Smith's body in it and towed it to Belize City.

The police said Moh gave them a caution statement and took them to a location near his camp on Turneffe Island and pointed out an AK 47 assault rifle which he used to shoot Smith.

Justice Lucas has deferred sentencing until Friday October 27 in order to give Moh's attorney, Simeon Sampson, time to prepare a plea for mitigation. The prosecution was represented by senior crown counsel Yohhanhseh Cave.
