No File, No Trial For Accused Killer

The disappearance of the original deposition for the trial of Wesley Emmanuel and Jesse James Ochoa, charged with the murder of Orlando Gomez, has prevented the trial from starting.

The jury was empanelled on Monday, October 18 and the trial was to begin yesterday. But because the original deposition with all the written statements could not be located, Justice Adolph Lucas adjourned the case until today.

When the court convened today the original deposition was still missing. So Justice Lucas discharged the jury and adjourned the case until December 2.

Emmanuel and Ochoa were taken back to prison. Emmanuel was represented by Attorney Ernest Staine while Ocha was represented by attorney Dean Lindo. Gomez was shot and killed on June 16th 2008 in a feeder road located at mile 3 off the coastal road. Mennonite farmer Cornelius Schmidtt who was with Gomez, was shot 3 times but he pretended that he was dead and he survived.

Gomez and Schmidtt were transporting a bulldozer on top of a truck to Banana Bank when they were stopped by three men. One of the men who had a gun in his hand introduced himself as a police officer but he did not wear a police uniform and he did not produce a badge. They put Gomez and Schmidtt into a car and drove them to the feeder road and shot them. Gomez's body was found in the bushes in the area with a belt tied around his neck.
