Crippled By Prison Injury: Will Man Get Bail?

The hearing of an application for bail for 24 year old Dean Davis, a paraplegic charged with the murder of Erin Sutherland, was adjourned today in the court of Justice Troadio Gonzalez until Friday September 2nd.

The prosecution is objecting to bail for Davis, one of two prison inmates who was seriously injured on May 27, 2011 when the vehicle that was transporting them from Orange Walk Magistrate court to Belize Central Prison overturned. Davis suffered injuries to his spinal cord which left him paralyzed.

His attorney, Phillip Palacio is applying for a bail on the grounds that the management of the prison is not equipped nor staffed to adequately and properly deal with a prisoner in Davis' condition and that there is a serious and real risk to the life of Davis in the event of fire, hurricane or force majeure.

Sutherland was killed in Orange Walk Town on April 18, 2010.

Palacio was also applying for a bail for 29 year old horse jockey Andres Moreno, the second prison who was seriously injured when the vehicle overturned but the application was not necessary because on Wednesday Palacio was told by Director of Public Prosecution, Cheryl Lyn Vidal that the charge of Murder against Moreno has been withdrawn.

Moreno is paralyzed from the neck down. He won't be able to move his arms and legs for the rest of his life.
