Paraplegic Gets Bail

24 year old murder suspect Dean Davis was crippled in May when the police vehicle he was being transported in overturned. At the time, he was being taken from Orange Walk Magistrate's court back to prison.

It's a terrible twist of faith, and for the past month, the paraplegic has been trying to get bail - because he says he cannot get the specialized care and treatment he needs in jail.

But it's been a difficult fight, because it is very difficult to secure bail for persons accused of murder. But he got it today - when Justice Troadio Gonzalez offered him a bail of $25,000. His attorney Phillip Palacio told us how it was secured:..

"This morning we appeared before Justice Troadio Gonzalez in the Supreme Court of Belize and he granted bail to Dean Davis. Dean Davis is an individual who is charged with murder but on May 27 of this year he was involved in a traffic accident and he has been paralyzed from waist down. This morning Justice Gonzalez granted bail to him in the sum of $25,000 plus one surety of the same amount or 2 sureties of $12,500 each. He also attach some conditions to the bail; one being that his guardian needs to report to the police station about Dean Davis' whereabouts. Also he must not leave his premises unless he is seeking medical attention or unless he is attending court and also he has to surrender all his documents to the clerk of court, so those were the conditions that were imposed in addition to the amount set for bail this morning."

"I had filed the Notice of Intention to sue the government of Belize on behalf of Dean Davis and that was filed on July 26 of this year and so we had given the government a month's notice of our intention to sue but that was in relation to the traffic accident - the injuries that he have received in relation to the traffic accident. In relation to the suing of the prison, I am not aware of that and I have not received any instructions from Mr. Davis in relation to that incident."

"Speaking on the traffic accident itself. Is the prison responsible for his medical bills?"

"In terms of the medical bills I know that KHMH had issued some bills in relation to Mr. Davis. These are amounts that we would be claiming from the government in relation to that and also the treatment that we had receive at the prison - those treatment are totally at the expense of the Belize Central prison. In fact one of the grounds that we had applied for bail on is special infirmity and the fact that the Belize Central prison does not really have persons trained or specialized in the care for somebody who has his nature of injuries. That was confirmed when we appeared in court on September 9. The nurse although said that he was in a hospital setting - under cross examination we were able deduce from her that he was in a cell like any other inmate and also she had deposed that he was given 24 hours treatment at the hands of EMP technicians and in cross examinations I was able to extract from her that he was not being treated by EMP technicians but instead he was being treated by just first responders - people who were trained in first aid and these persons were prisoners; actually his cell mates."

Davis is paralyzed from the waist down.

Davis remains accused of the murder of Erin Sutherland. He is one of two prisoners seriously injured in that accident. Andres Moreno also received injuries to his spinal cord and was left paralyzed from the neck down. He was also accused or murder but the charge against him was withdrawn.
