Ladyville Police shot a man they allegedly caught committing a burglary this afternoon. 21 year old Ryan Lozano is in a critical condition at the KHMH – after police shot him in the midsection.
Ladyville Police shot a man they allegedly caught committing a burglary this afternoon. 21 year old Ryan Lozano is tonight at the KHMH in a critical condition – after he was shot by police. Police say that at 12:20 this afternoon, the responded to the report of a burglary in progress in Los Lagos. When they got there, they saw 27 year old Ladyville resident Lenny Benguche hiding behind the house while Lozano was walking out. Police say he had a crowbar and a knife and they cautioned him – but he continued to advance in, quote, "a threatening manner." Police then opened fire, hitting him in the midsection. But this evening 7news travelled to Ladyville to where the shooting happened. Neighbors confirmed that they heard 4 gunshots ring out – and when it did, they say the two men were already lying face down on the ground.
They said they saw neither a crowbar nor any knife. Lozano's mother was told by doctors that her son was shot twice- once to the back and once to his side. Tonight Lozano is on life support at the KHMH still hanging on to life and his mother Cynthia Usher, has still not been contacted by police. She said she has had troubles with her son.

"Well I was a bit rash at first because he's a child that I always talk to. I am not going to be on the media and say 'He's a Saint and he's innocent'. I always try to talk to him. I told him 'God has given us a purpose here on earth and if we don't use the purpose He gave to us, then one day He will seize your obstacle'. This morning I had a talk with him. And the station - if they are honest they could say around 7-7:15 I called the station for them to come and get him because he was arguing about a dog that my daughter had loosed. Up to now, not a police has showed up as yet. My thing is when I got the call it was from the hospital. That was around 1:30p.m and I told them to give me the message on the phone. They said they will not be able to give me the message on the phone and that I would need to go over. I said 'just give me the message because I already heard that my son was shot'."

"Up to now the Police still has not called me."

"So it was someone from the hospital?"
Cynthia Usher
"Someone from the hospital that knows me called. A person that taught one of my sons at Technical High School. My son was talking when he went into the hospital. He was talking good. Up to the hour no one has called me yet from the Police Station. I called a friend of mine to find out if it was the police that shot him or the owner. My thing is they say this is the shirt that my son had on. This was the shirt the doctor gave to me. He was shot in the back. A bullet is lodged in his chest. The bullet that is in his side took out his entire Right Kidney. The top of his Liver is gone. There isn't any bullet at the front of him. This shirt doesn't have any bullet wounds. His pants and boxers are bloody. Where are the bullet holes on this? The doctor said when he came that piece of his intestine was gone and his kidney was already out, he didn't need to do anything."

"His kidney was out they didn't see that any at all, it was already out. From rumors that we are hearing, my son was already detained. They had him on the ground and that explains to me why the shirt doesn't have any bullet holes. I am still waiting on the police. I guess I am going there but right now my son comes first."

"Tell us about his condition right now at the hospital."
Cynthia Usher
"He is very critical. I haven't seen him yet because the Doctor said he was there. I don't remember the time they told me they took him in. I wasn't informed until around 1:30. So when I got there he was already in surgery and when they got him out of surgery, he was put on life support. He is doing very bad. He lost a lot of blood, he received four units more. If he pulls throught then he has to take another surgery on Saturday. He has 18 gauz in him crushing his liver."
The burglar bars on the home had been ripped off with a crowbar and a rope, and a few minor items had already been stolen.
An independent investigation by the professional standards branch has been launched into the shooting.
We should note that Lenny Bennett was in the news in 2008 when he was charged for maiming Christina Zetina – a charge which he was acquitted of. Zetina famously lost her leg due to the gunshot injuries.
Lozano also has charges pending, but is more well known to us in the media as one of two adults in the house with Baby Kaylee when she died. He is the boyfriend of the deceased baby Kaylee's aunt – the aunt who was babysitting the infant.
