Convicted Murderer Appeals His Case

Belize Court of Appeal today reserved it decision for a date to be announced for the appeal of 21 year old Abimael Pott, a construction worker of Orange Walk Town who was convicted of murder and sentenced to life imprisonment.

On May 6, 2014, Pott was convicted of the murder of 19 year old Shamir Gonzalez, which occurred around 4:30 p.m. on May 4, 2011, in the compound of Luisiana Government School. Gonzalez was bludgeoned to death with a metal pipe during a fight.

Justice Herbert Lord was the trial judge and the trial was heard in Orange Walk Supreme Court. Pott's attorney, Hubert Elrington appealed on the ground that the judge misdirected himself on the law which required the jury to find that the accused intended to kill the deceased. Elrington further submitted that the judge used a lesser standard that the accused intended to kill and not cause serious bodily harm. Elrington also submitted that the judge apparently found that it was a fact that the accused had used excessive force in defending himself which is a defence in law to murder, but he did not direct himself to the law governing excessive force in cases of self defence.

The respondent was the Director of Public Prosecutions, Cheryl Lyn Vidal.
