Belizean Charged With Rape; Says It Was Consensual

Today, police arraigned the man accused of raping a Canadian woman in his Belize City apartment one week ago.  46 year old Derrick Gabb of an apartment on Faber's Road was charged with rape when he appeared today before Senior Magistrate Aretha Ford. No plea was taken because, and the prosecutor objected to bail, saying that the police have a strong case and because of that Gabb might not appear in court if granted bail.  

But Gabb's attorney, Herbert Panton submitted that the prosecution has nothing close to a strong case. He also submitted that there is video footage of the entire event - which has been described as an orgy in today's Guardian newspaper. 

The Canadian woman reported to the police that she and her husband were socializing with friends and she fell asleep. She said she woke up to find Gabb raping her. Gabb has told police another story - that it was kind of a swinger's party - and provided a cellphone video recording - which allegedly depicts the woman along with her partner having sex.  The video also allegedly shows that there was an invitation by the couple for the accused and his girlfriend to engage in sex with them.

Today, we tried to ask the police spokesperson about it at the Bi-weekly police press conference, but he was very careful in his comments:

"We've been made to understand that the person she's accusing has turned himself in and has reportedly provided information and evidence disprove this woman's allegation against him."

"What I can confirm is that indeed the gentleman handed himself in. I had commented on the case on Monday that it was a Canadian national and that the suspect who is now accused because he has been charged and he has been charged or was charged yesterday for rape. However I don't want to go into details in regard to that matter."

Senior Magistrate Ford offered Gabb bail of $6,000 - on the condition that he does not contact or go near to the complainant, and that he reports to Racoon Street Police Station every Friday.
