BWSL Resisting PUC Ordered Rate Reduction

It kind of went under the radar, but BWSL has not implemented the lower rates ordered by the PUC. It's not "OPEN DEFIANCE" - because the utility did go to court for judicial review. So, that has put the new rate package on hold until the matter is heard later this month.

But, in January of this year the PUC took an initial decision to approve a 6.39 percent reduction in your water rate. That was supposed to come into effect on April first, but on March 19, 2018, BWS filed an Urgent Without Notice Application for Permission to Apply for Judicial Review and Interim Injunction against the new rate package. The Supreme Court granted BWS an ex parte injunction restraining the PUC from implementing the new rate.

Yesterday we asked the PUC Chairman about it - and he made it clear that he isn't happy with BWSL:...

"Are you of the opinion that BWSL is flaunting the authority of the PUC?"

John Avery - PUC Chairman
"Well, they have the right to go to court. Everybody have the right to go to court if they feel aggrieved about anything."

"Let me put it this way Jules, because I don't want to prejudice any case. The PUC as you have seen in public hearings we have had for BWS year after year when we do rate review, we are not satisfied with the performance of BWS. I will just leave it as that"

BWS is asking the Supreme Court to void the 2018 Annual Review Proceeding. The matters goes to court at the end of this month.
