Dr. Alain Wins Re-Instatement At KHMH

And while city hall isn't re-instating, at the KHMH a doctor who was fired didn't need a labour union - he just needed a good attorney.

One month ago we told you about Dr. Alain Gonzalez, the former two term UDP City Councillor who was abruptly fired from the KHMH - after 10 years and one month of service. And not only was he fired without a chance to defend himself, he was escorted out of the hospital by security. But, Gonzalez didn't blow them up with a scathing interview or Facebook post - he got a lawyer, filed an appeal with the board of directors and bided his time.

And it paid off, because he has been re-instated. 7news has confirmed that Gonzalez is back at work and transferred form the emergency room to the surgical ward. His attorney Godwin Haylock argued to the board that Dr. Gonzalez's Letter of Termination wrongly relied upon the Section 37 of the Labour Act for termination and benefits. That part of the law allows for termination of an employee without reason. But, Dr. Gonzalez was hired under the terms and conditions laid out in the KHMHA Handbook of Policies and Procedures, which does not allow termination without reason. And the Handbook also requires that when a labour matter arises which is not provided for in the handbook, then the Public Service Regulations are to be applied. So, on both counts, the Labour Act could not be used.

In his 10 years at the hospital, his lawyers pointed out that Dr. Gonzalez had received glowing appraisals year after year.
