Cayo Cops Confrontation Being Reviewed By DPP
posted (May 31, 2018)
And another reason the cops lose respect in communities is because the public perception is that they don't play fair: That there's a law for police, and another for civilians. That's how one of their own feels tonight after a constable publicly pulled a gun on him and cocked it.

That would land you in jail, but this police constable got a disciplinary charge and is now back at work at the same station with the cop who he allegedly pulled the gun on.

Today we asked the head of National Crimes Investigation about it:..

ACP Joseph Myvette - Head, NCIB
"Yes indeed, there was an incident involving two constables, one being PC Benjamin. There is an ongoing investigation and it is my understanding that PC Benjamin has since been charged disciplinary, but court action is requested so the file is being reviewed in order to determine whether there is sufficient evidence to substantiate any charge."

"Okay, sir is there a higher standard or a higher threshold of evidence for police officers who commit offences insofar as this was caught on security camera, it happened in plain view of other officers, there are corroborating statements from the duty officer, the sergeant at the time, if anyone does that in the street against a police officer in plain view, on security camera and there are corroborating statements, they would have already been remanded."

ACP Joseph Myvett
"In this case it did not happen in that manner, in that in its preliminary stage I have been informed that the constable requested no court action, but later on requested court action into the matter, hence the reason."

Reporter
"Corporal Audrey Moody who was quite quickly charged when I'm told court action was not requested by the victim, Constable Esquivel and I'm told he did not request action, yet she was still charged and remanded for 3-4 nights at the Hattieville Prison. Is there is a difference in treatment when it comes to male officers as opposed to female officers?"

ACP Joseph Myvett
"No, there is none."

Reporter
"But you see the inconsistencies."

ACP Joseph Myvett
"What happen is as I had mentioned to you before is that the constable did not request any court action."

We'll keep following the case. Our investigation into this story suggests that there may also be a racial element influencing the handling of the case.
