Murder Conviction For Killing 11 Year Old

A man has been found guilty of murder - and it's for killing an 11 year old boy.

Little Daniel Matura was shot and killed near his family's home on Central American Boulevard in May of 2012. Today 35 year-old Andrew Willoughby was convicted of the child's murder in a trial without jury.

Justice Marilyn Williams presided over the trial, and she heard the prosecution's lead evidence that on May 21, 2012, Willoughby let off a barrage of gunshots at Brandon Taylor and Roy Felix, who were riding past the the Matura residence.

Both targets raced off, and little Daniel - who was running across the street, returning from a nearby shop - ended up in the line of fire, and 2 of the bullets struck him to head and the chest, killing him on the spot.

The crown counsel called 3 eyewitnesses, and all 3 positively identified Willoughby as the shooter who gunned down the boy. Back in May of 2012, police recorded a caution statement from Willoughby in which he admitted that he was the shooter, but the validity of that statement was tested in a trial within this trial. Willoughby told the judge that he didn't voluntarily give the statement. He said that police beat him, and they offered him a deal.

After consideration, Justice Williams rejected Willoughby's claim that police coerced him into making the statement. The judge upheld the confession statement, and admitted it into evidence.

He then gave a statement from the dock in his defence, in which he claimed that at the time of the shooting, he was at his girlfriend's house, and that police picked him up at her gate.

After reviewing all the evidence, Justice Williams found that the prosecution had adequately proved that Willoughby was the shooter, and she found him guilty of murder. She has scheduled sentencing for July 17, at which time, she will hear his plea for mitigation. Willoughby was represented by attorney Leeroy Banner.
