Killer Gets 6 Months (After 8 Yrs. On Remand)

He killed a man when he was just 15, and today the judge told a now 23 year old Lincoln Gomez that he only has to spend 6 more months in jail for it.

Gomez had pleaded guilty to manslaughter a week ago for the 2010 killing of tour guide Glenstine Martinez. Gomez's attorney, Dickie Bradley said that he was a minor at the time of the incident and that he saved the court time by not having to go through a trial. Bradley also added that Gomez has been in prison for 8 years and 6 months.

Crown Counsel Killeru Awich, who represented the Crown, conceded that Gomez had no previous conviction, and that he lacked formal education.

In determining Gomez's sentence, Justice Colin Williams said that the starting point is 15 years and he must deduct a third of that sentence because Gomez pleaded guilty at the first opportunity. Having made that deduction, 10 years was left. Justice Williams said he has to reduce the 10 years to 18 months because he is deducting 8 years and 6 months for the time Gomez has been on remand.

Justice Williams deducted a further time of 1 year because Gomez was a minor at the time. So, the sentence of 6 months is to take effect from today's date.

Martinez was washing his van in front of his home on Central American Boulevard when Gomez rode up to him on a bicycle and they had an exchange of words. Gomez left and returned shortly afterwards and shot Martinez in the back of the head.
