Bail For Another Alleged Murderer

Today another alleged murderer got the very rare Supreme Court bail. He's Daniel Myvette, and he has been on remand at the Belize Central Prison for 8 and a half years.

Myvette was arrested and charged along with 2 other men back in February of 2010. Police say that the trio was responsible for the murder of a security guard at the Biltmore. After waiting 5 years for his day in court, he was tried, but his co-defendants were acquitted. When it came time for the jury to decide on him, they could not come up with a verdict, and so the case ended in a hung jury.

A retrial was ordered, and that is still pending.

His attorney, Alifa Elrington-Hyde, applied for bail to the Supreme Court back in February of this year. Hyde argued before Justice Marilyn Williams that the original trial was not fair to her client. The DPP's Office argued that there was sufficient evidence linking Myvette to the murder. Justice Williams refused that first application and denied him bail.

His new attorney, Leeroy Banner, returned today before Justice Herbert Lord with a second application, and since there was no objection from the Crown Counsel Sherigne Rodriguez, the judge granted him bail this time around.

That bail was in the sum of $40,000, and it comes with the conditions that he must report to the police station every week, and he has a daily curfew of 8:30 a.m. to 6 p.m. He must also stay away from the prosecution's witnesses, and he must attend all adjournments at the Supreme Court, until his case is retried.

By 1:00 this afternoon, he was able to meet bail and go home.
