After 26 Years, Killer Freed

And, another convicted killer got his new sentence today.

Last Thursday, we told you about 60 year-old Nicolas Guevara, a Salvadoran who has served 26 years in prison after he was convicted of murder. He was sentenced to life in jail, but because the Caribbean Court of Justice has quashed mandatory life sentences for murder, the Supreme Court decided that he need to have a new sentence.

Well today, Chief Justice Kenneth Benjamin has set him free after consideration. The judge decided that his new sentence should be 25 years in jail for the murder conviction. But, as we told you, he's already served 26 years, and so, his time in jail has amounted to time served. Guevara has indicated that he intends to return to El Salvador after he is released - which should be in a few days.

On December 16th, 1993, Guevara was convicted of the murder of 36 year old Marcus Antonio Tzul and he was sentenced to death. He was on death row for almost 7 years before his sentence was commuted to life imprisonment by the Privy Counsel. Because of a ruling by the Caribbean Court of Justice in the appeal of Gregory August, the Supreme Court was obliged to give Guevara a new fixed sentence.

Guevara was convicted of killing Tzul at the Gold Button Ranch in Orange Walk in 1992.

He was one of three men who ambushed Tzul and a female co worker, killed him, and and then took the woman in the car and drove with her for about 30 minutes before they stopped near the Mexican border. She said the men then gang raped her, stole her jewelry and took the keys to her car and left. The other two men who were involved in the incident were never caught.
