Three Brothers For Murder

A month ago, we told you about the conclusion of the murder trial without jury for the 3 brothers: 46 year-old Phil Staine, 37 year-old Kareem Staine, and 41 year-old Orlando Staine. The prosecution showed evidence that in January of 2015, they were personally responsible for the stabbing death of the 23 year-old BDF volunteer, Denver Villafranco.

Well, after consideration of all the evidence, Justice Adolph Lucas has returned with a decision acquitting both Kareem and Orlando Staine. The judge has also found the third brother, Phil Staine, not guilty of murder, but guilty of manslaughter.

As we told you, the prosecution called 3 main witnesses, and one of them testified that he saw Villafranco, the deceased, and the Staine brothers fighting in a drain. That same witness also said that Phil Staine was the one who inflicted the stab injuries to Villafranco.

In their defense, each of the brothers gave a statement from the dock admitting that they were involved in a fight with Villafranco, but they say that they were not the ones who stabbed him. Orlando Staine told the court that it was one of the prosecution's witnesses who took the knife and stabbed the victim to the right side of the abdomen. Orlando also added that this witness drove them to an apartment behind Lakers Cool Spot, showed them the knife, and told them that he was the one who stabbed Villafranco.

The judge did not believe Orlando's story, and his examination of the evidence indicates that Phil Staine was the attacker. In his ruling, the judge said that there was no evidence to indicate that Kareem and Orlando knew that Phil had a knife, and that he would use it to kill Villafranco. Justice Lucas said that he did not find that Phil intended to kill Villafranco. The judge also added that the doctor had testified that the force used was moderate to massive, and in a case where two inferences can be drawn, the inference favorable to the accused should be drawn. Consequently, Justice Lucas found Phil Staine guilty of manslaughter.

He has scheduled a sentencing hearing for November 14th, when Phil's attorney Bryan Neal will be allowed to make a mitigation plea on his behalf.
