Sulph Plans To Appeal Facebook Slander

On Tuesday Moses Sulph was served a judgement ordering him to pay megabucks for a Facebook post that slandered former UDP Minister Mark King. 

The court ordered Sulph to pay $30 thousand dollars in damages plus $10 thousand on legal fees in addition to being served with an injunction on future posts. Â 

By now you've heard from all parties on the winning side but what about losing side? In an interview with the Sulph today he told the media that he is not willing to throw in the towel just yet. And although he may still lose in the end, the thought of losing, he says, does not sap his fighting spirit.

"Yes I am going to appeal after reading the judgement and my lawyer read the judgement. Based on whatever grounds we can appeal because I don't believe that at this time that the outcome of the case is satisfactory and I don't believe that it was just in my opinion."

Reporter
"Have you consulted with him to arrive at this decision?"

Moses Sulph
"I spoke to my attorney and he says that he will read over the documents and if there are grounds for appeal, we will appeal."

Reporter
"So you believe that - you're saying that you're going to appeal because you believe that the burden of proof was wrongly, solely placed on your quarters?"

Moses Sulph
"I did not say that. I am saying that we will appeal based on the grounds on the ruling that the justice has given based on whatever grounds that is found in that ruling, we're going to appeal. If not, then I'll have to find a way to pay for the ruling against me."

Reporter
"That's a lot of money, 30 thousand dollars. Where will you get the money from?"

Moses Sulph
"Where will I get the money from? Well I don't know where I will get the money. Since I've been a public person, I'll definitely be going to the public if it comes down to that to go fund this or something because I'm not going to stop be an activist, I'm going to always speak out against injustice. However, I'll just be a little more prudent in making sure that I have tangible evidence."

Reporter
"Speaking of lessons learned, next time you find yourself in a similar situation, would you simply apologize?"

Moses Sulph
"I don't think I would find myself in the similar situation."

Reporter
"Do you want to apologize now? I know you mentioned thoughts of consideration of an appeal. No apology or at least a retracement of that statement?"

Moses Sulph
"I would not apologize because as I said before, if you feel you have done something wrong, then I would definitely apologize but at this time the information I had from the workers and continue to get information from those workers. I will not apologize. I learned my lesson that I must be more prudent."

Reporter
"You regret making the post?"

Moses Sulph
"No because I think even though I may loss in the court of law, I do win amongst the heart of the poor people who are being oppressed, who are feeling like they are being oppressed."

When asked about his intent to appeal, King's attorneys told us that although it is within his right to seek that recourse, failure to provide evidence to the court, which lost him his case in the first place, is not sufficient grounds for appeal. His attorneys also noted that an appeal is not a stay of proceedings; which simply means Sulph will have to pay up either way.
