Tutsi Gets off Weed Trafficking Charge

Last week, police corporal Darrell Tutsi Usher made national headlines when he published photos of the abominable conditions at the Queen St. station's detention cell.

At the time, he was being detained pending charges of discharging a firearm in public - and as we noted at the time, he was already under interdiction. Last week's firearm charge was dropped and the news tonight is that, now, he has been found not guilty of drug trafficking.

In March of 2017, the Corporal was accused of trafficking 20 pounds of weed. Police say he fled a checkpoint, - and when they got to his vehicle - which had been abandoned off Faber's Road, and a duffle bag with the weed was nearby. It was alleged that Usher was seen running off.

But, in court the case fell apart - notably with some of the police witnesses playing lost and alleging forgery by other officers.

One police officer testified that the statement that was shown to him was not his statement and that the signature on it was a forgery. Of the four officers who testified, three of them did not identify Usher. One of them said that he did not recognize the man he saw running. Another officer said he saw nothing and a third officer said they did not see Usher. Usher gave a statement from the dock in which he admitted that he was at the scene but he said he jumped in the vehicle and drove off because he frightened.

In assessing the evidence Magistrate Khadeem Palmer said that there were two flaws that raised doubts in her mind. She said that one of them concerned the two statements the officer denied were his and the fact that the female police officer said she used her flashlight to spot on Usher while another officer said that the only light came from the headlight of the police vehicle. She gave Usher the benefit of the doubts and she acquitted him. Usher was represented by attorney Anthony Sylvestre.

Usher says he is weighing his legal options for the damage done to his reputation. He is currently still facing charges before a police tribunal.
