No Manslaughter For Myers

An appeal 40 year-old Elario Elijio, who was acquitted of manslaughter, has been discontinued by the office of the Director of Public Prosecutions.

Eligio was charged with manslaughter for the death of 52 year-old John Myers, who is also known as "John Lamb". Myers died on February 27th, 2012, after a man punched him in the face, in front of a Chinese shop on Mahogany Street in Belize City. He fell and struck the back of his head on the ground; the blow killed him instantly. Police investigated the case, and they eventually charged Elijio with manslaughter for Myers' death.

At the trial, Justice Troadio Gonzalez upheld a no-case submission from Elijio's attorney.

The DPP's Office appealed the acquittal on the grounds that the trial judge made an error in law when he concluded that the evidence led by the crown counsel was insufficient to establish a prima facie case against Elijio. The other ground of appeal was that the trial judge improperly exercised his discretion by refusing the Crown's application to stand the trial down until an important witness could travel to the court from another district.

But, it appears that the DPP's Office has reconsidered the appeal, and on February 28th, a notice was sent to the Court of Appeal that they were discontinuing their appeal against Elijio.
