Alleged Child Killer Gets Off

He's been on remand at the Belize Central Prison for 2 years and 5 months, but tonight 22 year-old Jayear Flores, the man who was accused of the double murders of 7 year-old Tyler Savery, and his 22 year-old cousin Porshan Pipersburgh, is free. That's after he was acquitted today in front of Justice Colin Williams.

You'll remember the case from November 2016. Tyler and his cousin, Porshan, were on their way to Moon Clusters Cafe on Daly Street in Belize City. They were near the entrance of the cafe when a white car drove up, and one of the occupants opened fire on them. Tyler died from a gunshot to the chest, and eventually, Porshan Pipersburgh also succumbed to the 2 gunshot injuries he suffered to the chest. Several days later, police arrested and charged Flores with their double murder.

It was a terrible tragedy where a child was caught up in a street war between adults, and Tyler's mother, Shakera Young, became an activist against gun violence. Well, court reports say that she was extremely distressed after Justice Williams announced that Jayear Flores, the man accused of killing her child and her cousin, was acquitted only hours after his murder trial started.

One prosecution witness who was was reportedly the only eye witness to the double murder testified this morning. He said that he was driving on Freetown Road, and when he slowed down in traffic three persons got into to the back of his vehicle without his permission. He said one of the men put a firearm to his side and forced him to take them to his father's house at mile 8 on George Price Highway.

Usher said the men then took his vehicle and they drove it to Belize City and they allegedly used to to commit the murders. Usher identified Flores in the dock as one of the persons involved in the murders but Justice Williams did not accept the dock identification because Usher did not give a detailed description of Flores in the initial written statement he gave to the police. Usher had also identified Flores in a group identification parade, but Justice Williams did not accept the group identification parade. Having no other eye witness, the Crown's case fell apart and Crown Counsel Portia Ferguson closed the prosecution. With that Flores's attorney, Yohhanseh Cave, submitted that Flores has not case to answer to, and Justice Williams upheld the submission and acquitted Flores.

Court reports suggest that Flores was very concerned about his safety immediately after he was told that he could leave. He is reportedly worried about street retaliation from persons friendly with the family of Tyler Savery and Porshan Pipersburgh. He left in a taxi from the court, which presumably drove him home to safety.

We have spoken with the grandmother of Tyler Savery, and she told us that her daughter, Shakera Young, was devastated by the outcome of today's trial.
