Did Hon. Elrington Misuse Authority to Place Hold On Titles?

Elrington resumed cross examination for about half an hour after lunch.  The trial concluded at around 2:00 - with Justice Abel reserving judgement.

We asked Elrington about the central allegation in this case - as attested by the Assistant Registrar of Lands in a witness statement - that he used the weight of his office to maintain cautions on the parcels of land - after they should have been listen in the normal course.  We asked Elrington about it:..

"You’re on the back foot you know, the CCJ ordered you to relinquish the titles, you didn't; a caution is still held on these titles because of you. It says in one of the affidavits before the court that you were adamant with the lands department that the caution should not be lifted; you used the weight of your office... That's what I saw in the sworn affidavit."

"You know recently the prime minister was commenting on affidavits that are put before people, it's sad, it's tragic that we stoop to this kind of depth. My thing is when they go low, we try to go high but you know me Jules, you can safely say that you have never, ever encountered me in any kind of compromising position, under no circumstance."

"And I'm prepared to spend more to make justice because if foreigners can believe that they can come to Belize, take advantage of Belizeans, they hire high profile lawyers to protect them. They can do it with most Belizeans, it will not happen with me. So if I have to go broke to vindicate my position in this one, I'm prepared to do that."

Both sides are to go back to court on September 17 to make oral closing submissions.

We note that Elrington has another suit against Progresso Heights currently before the Court of Appeal.
