PSU's Hilltop Flip Flop, Explained

Last night we told you how the PSU had done a major flip flop on the position it has taken on its Hilltop headquarters in Belmopan.

Last week the Union President publicly conceded that the union's general membership has agreed to abandon the claim for the property and try to get some kind of payout for what it called "equitable interest."

But, in a total reversal, the union yesterday sent a release saying it's going to put up a legal fight to hold unto the property. And, all this is based on some new document, which suddenly gives them firm legal footing, firm enough to go to court.

Today, PLUS TV asked the President to explain:..

"We believe that we have legal rights to at least be the first choice to acquire the land. The problem back prior to the newest release is that we didn't have the documentation that we felt could support that position. So lately we have encountered one such document and we believe that that will now strengthen our case going forward. We have passed it on to the legal advisors and they have decided that yes it is indeed a significant piece of evidence and they believe that that should tilt the scales in our direction."

"The first mandate that we got from our members when this whole issue of the sale came about was to fight and then it swung the other direction when we had the legal advisors telling us that well we didn't seem to have enough evidence on our side to mount a credible case, then we of course decided that we were going to abandoned the claim for the property itself, but still maintain the claim for the equitable interest part and now we came a full 360 degrees and we are back ow due to the fact that we have new evidence that supports now our position that indeed we should be at least given the first option to purchase."

"Are you at liberty to share some of what that new evidence might entailed?"

"I wouldn't want to say anything that might prejudice, although it is that we will have to disclose any way, but I have not gotten that directive as yet from the legal advisors that we could we could go ahead and speak on it. It certainly has to do with some previous exchanges that took place that we were not aware that we had that documentation."

"We are looking at the process by which they acquired the property and so if the process itself was done illegally, then the end result cannot be legal. Meaning that Simplex cannot be the legal owners of the property. We get the confidence that it is the best thing to do to move forward with the case and so we will be filing first. I guess that's suggestive of the confidence that we have that they actually want us to be the ones to put our case first that we are in the fight now for this property and like I said, gotten this documentation that we strongly believe that will take us through to a successful case and we look forward to maintaining our property, because rightfully it is. Not only I don't see it, I went to Belmopan Comprehensive and I don't see Hilltop as only PSU, it has always been a part of the community. It has been something that the community holds on to and so for it to fall into foreign hands, especially in the manner that it did, I don't think it is something that leaves a good taste in the citizens of Belmopan mouths."

But, while the Union is the one going to court on the offensive this time, it will still try and hold unto another replacement piece of land, just in case:...

"We have that confidence based on the legal advice - there is always the possibility and so it's based on that that we've decided to let's look and see in the case where for whatever reason we are not successful in this court case that we have somewhere to fall back on. It's just a matter of being proactive and to ensure that if the likelihood that we lose the case that have somewhere else to go and if that's not the case and we can acquire somewhere else, then it's an asset for us that we can probably rent out."

The eviction action from the current owner of the property, SIMPLEX Design Company is set to commence at the end of this month.
