Calaney Walked Out of Appeals Court Free Again

Turning now from crime To Court News, Calaney Flowers was back in the court of appeal today.

She's the woman who had been acquitted of her former boyfriend's murder in March of 2017. In 2012, Lyndon Morrison died when he was hit from behind as he and his new girlfriend were traveling on his motorcycle on Freetown Road in Belize City. Flowers was the person driving the car that hit Morrison and his girlfriend, Sochyl Sosa. In one of his final judgements, Justice John Gonzalez acquitted her after a full trial.

The DPP's office has been determined to appeal that acquittal and matter came up today at the Court of Appeal.

But, crown counsel Sheniza Smith didn't have much luck before the panel led by President Manuel Sosa, along with Justices Samuel Awich and Minette Hafiz.

Sosa spoke about the finality of an acquittal and dismissed the applicant to appeal for want of jurisdiction.

Flowers was represented by Anthony Sylvestre who spoke to us afterwards:

"That has never been a type of acquittal that the D.P.P. could throw out or our legal system could appeal. That point was made. You were in court and you saw the justices of appeal and the president they took the point and they decided in our favor."

"Miss Flowers' case has been one of the most widely reported on and one of the most - she was accused of a outstanding gruesome crime. I'm saying that what now is her status? We know that she has been in the US, she was returned here I understood for proceedings here. What now happens to her?"

Anthony Sylvestre
"As it relates to what happens to her, so all proceedings against her they have come to an end as it relates to this particular matter that you related. I cannot say and I am sure she would not publicly say what she will now do but certainly as it relates to all proceedings in this matter it has come to an end. You are right. It was an incident which gritted the Belizean public and the proceedings after so many years has come to this particular path, to this end."

"There is no foreseeable way that anything can be brought back against her at this point having now tried this second attempt?"

Anthony Sylvestre
"The D.P.P., they would still have a right to appeal the decision just being made by the Court of Appeal. Such a decision can be made within 42 days from the date when this court of appeal produces its written decision. So that is foreseeable possibility."

Flowers had left for the US after her acquittal.
