Candy, The Crowfoot and City Hall

On Friday, October 4th, we told you about the almost half a million dollar judgement that Candice Miller, the former administrator won from City Hall. She was dismissed for gross dereliction of duty shortly after the council took office in 2018.

Well, the Supreme Court found that firing to be wrongful, unlawful and without cause. The judge ordered the cash strapped city hall to pay Miller $378,175 dollars for breach of contract of employment, plus another $70,000 dollars in costs.

That's almost half a million dollars, and Miller's camp isn't wasting any time in getting her money. Miller's attorney Magali Perdomo filed a writ of execution on Friday. That's when a bailiff goes to take possession of the property of the party which owes for a judgement with the purpose of selling those assets to recover a judgement payment.

And today, that's just what happened when the court bailiff went to the City Hall's works compound at mile four to start marking items for Crowfoot seizure.

Now, the City Council filed its appeal of the judgment today - but to stop the writ of execution - city hall has to get a stay of execution - which is another application. So tomorrow, the bailiff is expected to go to city hall's office to continue to designate the city's assets to be crowfooted.

And tonight that has the city council crying foul. The council issued a press release titled "Candice the Crow" and it says, quote, "the appeal period expires twenty one days after the judgement is handed down. However, Ms. Miller has opted not to honor this grace period and filed an Execution of Judgement only fourteen days after the ruling….This act has been received by the Council as discourteous on Miller's behalf and detrimental to the public, as she is aware that the seizing of said assets would impede the Council's ability to serve the residents of Belize City. Despite the council's filing of an appeal well within the allotted period, Miller for her own reasons, has taken the unconventional direction of expediting the execution of the court ruling…we strongly condemn this act of bad faith…"

Of course, the other side will argue that this is defamatory and that the bad faith was exhibited in the rash dismissal of the most senior and highly paid official in the council. We'll keep following this story tomorrow when the crowfooting is expected to move to City Hall's offices.
