Environmental Charges Dropped Against Dion’s Mom

43 year old developer Dion Zabaneh and his 76 year old mother Primrose Gabourel have been in court for months - but, tonight, all charges against her have been dropped.

It happened in Magistrate's court today where the DEO dropped the charges. We asked the DOe's Legal Counsel Jeavon Hulse about it:

"Today the prosecution called its last witness and we close our case. After that the attorneys for Mr. Zabaneh raised a no case submission and we agreed on dates when we would submit a response."

Reporter
"I also noticed that his mother Miss Primrose Gabourel is not here this afternoon, I saw her here this morning. Why was she absent this afternoon?"

"The charges against Miss Gabourel were withdrawn based on the instructions I received."

Reporter
"And that happened this morning?"

Jeavon Hulse, Legal Counsel, DOE
"Yes."

Reporter
"Can you tell us why it came to that that it was withdrawn?"

"At this point I cannot go into a lot of details."

Reporter
"Tell us again what charges is Mr. Dion Zabaneh facing still?"

Jeavon Hulse, Legal Counsel, DOE
"He has 6 charges that have been laid before the court, one is: failure to obtain environmental clearance, he have 4 charges in relation to failure to comply with lawful instructions given by an authorized officer and the last one is obstruction of an authorized officer in the conduct of his duties."

Today, Zabaneh's attorney Emil Arguelles cross examined Chief Education Officer, Martin Alegria about the difference between a stop order and an enforcement notice as in the trial, the two terms were being used loosely and he wanted clarification on them.

After he left the stand, the DOE closed its case and Arguelles informed the court that he will be making a no case submission on behalf of his client, Zabaneh.

As you heard, the prosecution will respond to that next month.
