Simplex Will Sue PSU, Here’s Why

As we told you last night, The Public Service Union has taken the fight for their Hilltop Headquarters to the Supreme Court in front of Justice Courtney Abel.

But, their suit suffered an early setback when one of the key defendants, Simplex Design got the judge to agree that the matter against them should be struck out.

That's key, because Simplex has the title for the Hilltop Property. Today, Simplex's attorney Steve Perera discussed the significance of his client being struck out, and his pending countersuit against the PSU:

"After carefully reviewing it were of the view that there was no cause of action against the second defendant which is our client, SIMPLEX. And as a result we decided to file an application to have the entire claim struck out was against SIMPLEX. The reason behind this is that our client SIMPLEX holds a land certificate, and, under our laws, if you have your land certificate under the registered land system that's what you refer to as an indefeasible title."

"Ultimately, the court agreed with our position and we were successful in having the matter struck out as against SIMPLEX. And, so, currently, there is no claim against us in respect to our title."

"If the court has said SIMPLEX is not a party to this it means that simplex, which holds that title now holds it irrevocable?"

Steve Perera
"We hold that title until and unless it is every set aside."

"But it means that simplex is the undisputed owner of hilltop."

Steve Perera
"Yes, at this time, yes. We have a counterclaim against the PSU wherein we are seeking that the PSU vacate the property. That's to be heard, but that hearing will come up for the first time next week and then from there the court will hear the case and will take it through its necessary stages and ultimately make the decision whether or not they will evict the PSU from the property."

"Was there any point at which SIMPLEX and PSU went into negotiations for them to buy back from SIMPLEX their treasured hilltop property?"

Steve Perera
"Well, as in all cases it is always preferred and suggested that the parties try to meet and see whether or that there is a possibility of settling the matter and there's a possibility of selling the property to them. And that had been on the table in the past. I do believe that some discussions were taking place but there hasn't been any finality to any of those discussions as yet. We hope that there is still room for discussions as to both the parties amicably settle everything."

"We believe that just judging by the optics that SIMPLEX is like a paper company. That's my interpretation. Does SIMPLEX actually have plans to the property or is it just speculation to get it for a fair price and sell it for a fair profit or a tidy or a handsome profit?"

Steve Perera
"The company is not a paper company. It's a company that intents to do some development on that property. They accurately working on a number of ideas and concepts for the property. So I do believe, they have very much intention to continue with investing and making the property worth a lot more in the future."

The counter-suit by Simplex against the PSU goes to court on Monday.
