Carolette Gideon, also known as The Real Deal, has been in the News this week. That's because of her impassioned campaign to get help for her grandson after he was knocked down on Faber's Road extension.Â
Well, get help she did. Attorney Steve Perrera saw our story and contacted Gideon to take the case on Pro-bono. He went to the insurance company and invoked an underutilized clause called "no fault". It basically means, despite who is at fault, the insurance company is liable to pay medical expenses up to five thousand dollars. Stever Perrera- Attorney at Law
"Well, what happened was that I heard the story from one of my legal assistants and she was speaking about the situation and I overheard the details of it and it kind of just stood out wrong to me and I had to find out whether or not that was in fact the situation that they were going through. I was later called by a family member who lives on Faber's Road who asked me to assist with the matter and I myself, having grown up on Faber's Road, thought that it was important for us to look after situations where we can help. So, especially being that it happened in an area where I grew up, they provided me with her contact information and we reached out to her to see how we could assist in any way because the fact that the young boy who is 8 years old required the medical assistance on an urgent basis, we felt that it is important that we try, as soon as possible to see how we can assist them. The good news is that since we started assisting Ms. Gideon, we were able to get the information from the police department, find all of that information out. We also discovered that the vehicle that was involved in the accident is insured by Atlantic Insurance and we were able to contact Atlantic Insurance and we sent them a letter indicating that Dijon required this urgent assistance and he required several scans to be done to ensure that he is okay and that there is nothing happening with his head where he got hurt."
"So far, today, we have been in contact with Atlantic Insurance and they have indicated that they are looking into the matter and that they will be assisting Ms. Gideon and Dijon. Everyone in Belize needs to understand that when an accident like this happens there is a specific section in the insurance act, it is under the motor vehicle third party risk insurance act and a lot of people don't take advantage of this but what it does say under the act is that if an accident occurs, anyone who gets injured in the accident they are able to approach the insurance company, whichever insurance company insures that vehicle and they are able to request up to $5,000 in medical assistance. That is in respect to any injury that they have regardless of fault. So, it is termed under the rule of no fault. It is referred to as no-fault-clause. And so, with that, anyone who gets injured, who gets knocked down, for example, in this case Dijon, they are able to approach Atlantic Insurance and ask them for that assistance for medical assistance up until the amount of $5,000 Belize and that is exactly what we are doing at this point in time. We are seeking the assistance through Atlantic Insurance to have him benefit under that clause, the no-fault-clause."
He told us how this worked out real well for The Real Deal's grandson.
Dijon Dawson's family will be able to access up to $5000.00 toward his medical care at Belize Healthcare Partners.
